Containerized Trash

No loose black bags on the curb. All commercial trash must go into sealed, lidded containers — effective March 2024.

What is Local Law 116?

Local Law 116 of 2023 requires all commercial businesses in NYC to use sealed, rigid, lidded containers for trash set out for collection. Loose black plastic bags placed directly on the curb or sidewalk are no longer permitted — at any time, for any business.

This law is part of NYC's broader containerization initiative aimed at reducing the city's street-level trash pile that has long characterized NYC sidewalks and contributed to rat infestations.

Important distinction: Bags inside containers are fine. The violation is bags placed loose on the curb or sidewalk — not bagging your trash. You still bag it, then put the bags in a container.

Container Requirements

Containers must meet the following specifications:

  • Rigid — not collapsible, not soft-sided
  • Lidded — lid must be securely fastened when set out
  • Maximum 55 gallons in size
  • Must be placed at the curb, not on the sidewalk blocking pedestrian flow
  • Can only be set out during your district's allowed hours — check DSNY for your district
Setting out too early is also a violation. Check your DSNY district's set-out times at nyc.gov. Most commercial districts allow set-out starting at 8pm the evening before collection.

How to Comply

    Buy containers. Standard 32–55 gallon rigid plastic containers with locking lids work. They're widely available at hardware stores and restaurant supply shops for $15–$40 each.

    Bag trash as normal, then put bags inside the container. The container goes to the curb, not the loose bags.

    Only set out during your allowed window. Check your district at nyc.gov/dsny. Most districts: not before 8pm the evening prior.

    Bring containers back in after collection. Containers left on the curb or sidewalk after collection can also generate a violation.
